AbstractIt is argued that the Hong Kong legal system as well as the existing statutes governing the legal status of children and the family were not originally intended to cater for the emerging concept of children's rights. It imposes a primary obligation on families to care and protect children as a matter of legal duty owed to the state, as parens patriae, and not as a matter of r̀ight' that parents owe to their children.
