| Abstract | The protection of trade marks and trade names has a century-long history in Hong Kong, yet attempts to pass off one's goods or services as those of another still occur - sometimes successfully. A more effective way of preserving one's goodwill is to prevent it from being attacked. And this strategy is recognised in the Trade Marks Ordinance which stipulates certain restrictions on the registration of trade marks. This article focuses on the case in which Swiss watches and timepieces maker Omega SA opposes to the application of registration of its trade mark in Hong Kong by Charming Company Limited. |
