| Abstract | In legal practice, applications for amendment are often resolved with the consent of the defendant and counsel may not always be very familiar with the details of applicable laws. This tends to camouflage not only an array of unanswered questions but also considerable conflict of legal principles. This article therefore is mainly concerned with the possibly minimal amendment powers of the District Court, though problems involving amendment powers exist in other jurisdictions. There is no question that amendment powers do exist in magistracies and in the High Court, even though their precise nature and scope are far from certain. The problems are more clearly understood if seen against the backdrop of the amendment powers existing in the three Hong Kong criminal court jurisdictions. |
