AbstractThe influence of Albert Dicey on British constitutional theory has been immense yet, in recent times, often derided, particularly for his claims regarding the rule of law. Yet British-educated lawyers often seem to have been somewhat mesmerised by it, unable to think and reason beyond it. Their colleagues in other jurisdictions where codified constitutions exist have generally escaped blind adherence to Dicey's views. Even in Hong Kong's legal system, dominated by British-educated lawyers, it has been occasionally recognised that the competence of the local legislature is restricted in a number of ways.
