| Abstract | This article examines the possible jurisdictional bases of Barclays Bank v O'Brien and argues that the doctrine of unconscionability as developed by the Australian decision of Commercial Bank of Australia Ltd v Amadio offers a satisfactory one. The second part examines how courts in Hong Kong may contribute to the resolution of this jurisdictional issue. |
