AbstractThe difference between the PRC Maritime Code and the Hamburg Rules can be summarized as follows: 1. According to the PRC Code, maritime delay occurs only on the condition that the goods have not been delivered within the time expressly agreed upon; while under the Hamburg Rules the carrier will be held responsible not only because he has not delivered the goods within the time expressly agreed upon, but also because he has not delivered them within a reasonable time. 2. The carrier's liability for delay under the Code is limited to the freight; while the Hamburg Rules provide that the amount of limitation is two and a half times the freight, but not exceeding the total freight.
