AbstractJust like many local statutes which originate from their predecessors in England, the Limitation Ordinance is modelled on the Limitation Act 1939 and many of its sections are derived from their English equivalents. The ordinance has been successfully applied in numerous cases to resolve disputes concerning claims of possessory title to land in different parts of the colony until recently when a series of controversial decisions concerning land in the New Territories aroused widespread social concern. This article aims to highlight the crux of the main issue in these decisions and the shift in the judicial approach to such an issue by analysing four recent cases. In the article, the original and later approaches will be explained and compared after the basic facts of the cases are outlined.
