AbstractUntil the 1992 amendment to the 1984 Patent Law of the People's Republic of China ("PRC"). pharmaceutical products per se were not protected under the PRC laws. Patents could be obtained for pharmaceutical processes, but the protection did not extend to the products of those processes. With the opening up of the PRC market under the state policy of "Reform and Open Government" and the growth of PRC's own pharmaceutical industry, the Governments of the PRC and the United State recently signed a Memorandum of Understanding on Intellectual Property, which contributed to the above 1992 amendment and the 1992 Regulations on Administrative Protection for Pharmaceutical ("APP").
